In todays fast moving life everyone uses one or the other type of vehicle for movement and for transporting goods. It often happens that while moving on road the vehicle met with an accident either due to our fault or due to the fault of any other person. The accident results in injury or death of some unfortunate. The person hit by your vehicle creates pressure for recovery of compensation for loss of life or for injury sustained. Don’t worry, if your vehicle is duly insured and you have your D/L and other papers of your vehicle in order, the insurance company will pay the compensation. The injured person must lodge an FIR against the offending vehicle, keep all the bills, prescription of hospital and reciepts of medicines intact and in case of death the report of Post Mortem.
In injury cases actual medical expenses prooved are recoverable plus compensation for loss of job , disability sustained etc are awarded by the court. However, in death cases actual income of the deceased multiplied by expected life multiplicand is the basis of calculating compensation.
If no proof of income is available, nowadays Rs. 3000/- per month is taken as notional income. The maximum multiplier  is 18 hence the compensation after deducting 1/3 towards personal expenses , would be Rs. 4,32,000/-.
There is no time limitation to file these cases.
Any court where either petitioner resides or where opposite party resides or works for gain or where the accident took place, can adjudicate the case.So if accident occured in Delhi but injured or deceased resides in Bareilly, the case can be filed either in Delhi or in Bareilly courts.
